INTELLECTUAL PROPERTY AND OWNERSHIP OF AI-GENERATED WORKS IN NIGERIA: CONCEPTUAL, THEORETICAL AND LEGAL PERSPECTIVES
Abstract
There is a complex relationship between artificial intelligence and intellectual property law, with the constantly evolving creations of AI products in respect of ownership. This work examines the conceptual, theoretical and legal perspectives of AI- generated contents across copyright, patents and trademarks. With the rapid advancements in AI technology, machines are increasingly capable of autonomously generating creative works, raising novel legal challenges. It further examines the intellectual property implications of AI and existing legal frameworks. As AI technology advances, it is increasingly capable of creating innovative and valuable works, raising questions about who owns the rights to these creations. This paper further examines the legal framework for intellectual property rights in AI-generated works such as authorship, ownership and the potential for bias in AI decision-making. It concludes by evaluating the adequacy of current IP laws, and proposes potential solutions to address the intellectual property implications of AI-generated works in Nigeria.
